Introduction

These Terms & Conditions of Use and Sale (hereinafter the "Terms") govern the contractual relationship between BLITZ GROUP, a Société par Actions Simplifiée registered in France under SIREN 943 073 247, with registered office at 3 Rue du Coq Enchaîné, 14600 La Rivière-Saint-Sauveur, France, VAT number FR92 943 073 247 (hereinafter "BlitzAPI", "we", "our" or "us"), and any professional client (hereinafter the "Client", "you" or "your") subscribing to our Services.

By creating an account, subscribing to a plan, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not access or use the Services.

1. Definitions

For the purposes of these Terms:

"Account" means the user account created by the Client to access the Services.
"API" means the BlitzAPI application programming interface and related documentation.
"Credits" means the unit of measure used to consume the Services.
"Data" means professional business information (e.g., company details, professional email addresses, phone numbers, LinkedIn URLs) obtained via the Services.
"Plan" means the subscription tier selected by the Client (monthly, annual, or other available models).
"Reseller License" means a specific commercial license granted separately by BlitzAPI allowing redistribution of Data.
"Services" means all functionalities accessible via the BlitzAPI API, as described on our website.
"Terms" means these Terms & Conditions of Use and Sale.

2. Scope and Contract Composition

2.1 These Terms apply exclusively to professional B2B Clients. The Services are not available to consumers or for B2C purposes.

2.2 The Contract consists of:

Any signed commercial proposal or order form;
These Terms;
Our Privacy Policy.
2.3 In case of conflict, the order of priority is: (1) signed commercial proposal, (2) these Terms, (3) Privacy Policy.

3. Service Description

3.1 BlitzAPI provides an API-only platform enabling Clients to:

Search, enrich, validate and scrape publicly available B2B professional Data;
Access Data in real time according to the chosen Plan;
Use Credits to consume API endpoints as specified on our website.

3.2 No personal (non-professional) data is provided. All Data is strictly professional and intended for B2B use.

3.3 The Client acknowledges that:

Data accuracy may depend on third-party sources;
BlitzAPI does not guarantee 100% accuracy, completeness, or deliverability;
The Client is solely responsible for the use of Data in compliance with applicable laws (e.g., GDPR, CCPA, ePrivacy, and source platform terms).

4. Account Creation & Access

4.1 Account creation requires a valid professional email address.

4.2 The Client must ensure that Account information is accurate and up-to-date.

4.3 Credentials are personal and non-transferable. Any unauthorized use must be reported immediately.

4.4 BlitzAPI may suspend or terminate access in case of violation of these Terms.

5. License & Usage Rights

5.1 Subject to payment of applicable fees, BlitzAPI grants the Client a limited, non-exclusive, non-transferable, revocable license to access and use the Services for internal business purposes only.

5.2 Prohibited uses:

Reselling, redistributing, sublicensing, or making Data or API access available to third parties without a Reseller License;
Using Data for B2C purposes, consumer profiling, or any non-professional context;
Circumventing technical limits (e.g., request limits per Plan);
Scraping or reverse-engineering BlitzAPI systems.

5.3 Agencies may use the Data on behalf of their clients only under the Client’s subscription, without redistribution rights.

6. Plans, Credits, and Payments

6.1 Plans are monthly or annual, prepaid. Annual plans are payable in full upfront.

6.2 Credits are allocated at the beginning of each billing cycle according to the chosen Plan.

6.3 Additional Credits may be purchased on a pay-as-you-go basis only if the Client has an active subscription.

6.4 Free credits: 200 free Credits are granted once upon account creation.

6.5 Credits are non-transferable and non-refundable. Unused Credits from the current billing period will be carried over to the next billing period within the same subscription term. All purchased or allocated Credits automatically expire at the end of the second consecutive billing period following their allocation (for monthly plans) or at the end of the second consecutive annual period (for annual plans), whichever comes first, if not used.

7. Suspension & Termination

7.1 BlitzAPI may immediately suspend or terminate the Contract in case of:

Breach of these Terms;
Use of Data or Services in violation of applicable laws;
Attempted resale or redistribution without authorization;
Technical abuse (e.g., overuse beyond Plan limits).

7.2 No refund will be made for unused Credits in case of early termination.

7.3 Monthly Plans may be cancelled at any time before the next renewal date. Annual Plans are non-cancellable before the end of the term.

8. Data Protection & Compliance

8.1 BlitzAPI is GDPR and CCPA compliant.

8.2 We process only the Client’s account and billing information for contract execution, support, and internal marketing purposes.

8.3 We do not use Client-provided data to enrich our own database and do not sell Client data to third parties.

8.4 The Client must comply with all applicable data protection laws and the terms of source platforms (e.g., LinkedIn).

9. Intellectual Property

9.1 BlitzAPI retains all rights, title, and interest in:

The API, Services, software, and documentation;
All Data, except Data lawfully stored by the Client during the subscription.

9.2 The Client may keep Data obtained during the subscription for internal business use after expiration, but may not resell, redistribute, or create derivative works from it.
